These Terms of Use govern the Domino Junction beta provided by Vitality Research LLC under the Vitality Driven brand (“we,” “us” or “our”). They take effect when you accept them through the game or beta enrollment process. If you do not agree, do not participate in the beta.
Eligibility and parental permission
The beta is available to participants in the United States who are at least 13 years old. If you are below the age of legal adulthood where you live, your parent or legal guardian must review and accept these terms and permit your participation. A parent or legal guardian accepting these terms on a minor’s behalf agrees to supervise the permitted use. You may not participate if you do not meet these conditions.
Permission to use the game
Subject to these terms, we grant you a limited, personal, nonexclusive, nontransferable permission to access and use the beta for its intended gameplay and testing purposes. This permission does not transfer ownership of the software, branding or other protected materials. You may stop participating at any time.
Rooms and player identity
Use a display name you are entitled to use, and avoid including personal contact information. Keep room codes and session credentials private. Invite only people you intend to play with, and do not use another person’s credentials or attempt to access their private hand or session. We do not guarantee the identity or conduct of other participants.
Acceptable use
Do not harass, threaten or deceive others; use unlawful, abusive or infringing display names; impersonate another person; cheat or manipulate game results; exploit vulnerabilities; disrupt the service; introduce malicious software; or access information you are not authorized to access. Do not copy, redistribute or commercially exploit our proprietary code or assets without permission, except where applicable law permits it. Report security concerns privately to [email protected].
Beta availability and game progress
The beta is unfinished and may contain errors, interruptions or incomplete features. We may change game rules or features, reset scores and saved games, limit access or end testing. We do not promise continued availability or preservation of game progress. Participation does not guarantee a future release or entitlement to paid features. The game does not authorize wagering, and game scores have no cash redemption value.
Ownership and third party materials
We and our licensors retain rights in Domino Junction software, branding, artwork and other protected materials. We do not claim ownership of traditional domino gameplay methods. Third party software and materials remain subject to their applicable licenses and notices. Nothing in these terms limits rights granted to you under an applicable open source license.
Voluntary feedback
You may voluntarily send suggestions or report problems. You retain ownership of your feedback and grant us a nonexclusive, worldwide, royalty-free permission to use, reproduce, adapt and incorporate it to operate and improve our products and services. We do not owe payment for voluntary feedback. Submit only material you are entitled to share, and do not include confidential information. These terms do not impose a nondisclosure obligation on beta participants.
Privacy
The Domino Junction Privacy Policy explains how information is handled. Acceptance of these terms does not replace any separate consent required by law. Clearing local device storage or forgetting a saved seat does not itself delete server information. Send privacy requests to [email protected].
Suspension and ending participation
We may suspend or end access when reasonably necessary to address misuse, security risks, legal requirements or the end of beta testing. Where practical, we will explain the action and provide a way to contact support. You may stop using the game at any time. Ending access does not automatically determine retention or deletion of information; those matters are addressed in the Privacy Policy.
Warranties
To the extent permitted by applicable law, the beta is provided “as is” and “as available.” We disclaim implied warranties of merchantability, fitness for a particular purpose and noninfringement, and do not warrant uninterrupted or error-free operation. Nothing in these terms excludes a warranty or consumer protection that cannot lawfully be excluded.
Limits on liability
To the extent permitted by applicable law, we are not liable for indirect, incidental, special or consequential losses arising from the beta, including lost game progress or interruption of play. This limitation does not exclude or limit liability for fraud, willful misconduct, gross negligence or other matters where applicable law does not permit that exclusion or limitation. Your mandatory legal rights remain unchanged.
Changes and general provisions
We may revise these terms prospectively. We will identify the revised version, provide notice of material changes and obtain renewed acceptance when required. No revision retroactively removes rights that have already accrued. Applicable law and mandatory consumer protections govern your use of the service. If a provision is unenforceable, the remaining provisions continue to the extent permitted by law. Platform terms also apply when you use a third party distribution platform; that platform is not the operator of Domino Junction.
